How Can I Buy My Home?

You can buy your home as long as you meet some conditions:

Tenants who transferred from Stafford Borough Council
If you were a "secure tenant" when you transferred, you have a "preserved" Right to Buy.  This means that you can buy your home on the same terms and conditions as if you were still a council tenant, at a price lower than the full market value.

To qualify:

  • if you were a public sector tenant before 18 January 2005, you must have spent at least 2 years as a public sector tenant or in accommodation provided by the armed services, 
  • if your current tenancy was created on or after 18 January 2005, you must have spent at least 5 years as a public sector tenant
  • you must live in a property which is self-contained and your only or main home.

You will not qualify if:

  • you are an undischarged bankrupt or have a bankrupcy petition pending against you;
  • you have an arrangement with creditors and you still owe them money.

Key Points of Information:

  • If you apply to buy, we will accept or deny your Right to Buy within 12 days of you applying.  if we deny your Right to Buy, we will explain why.
  • If we accept your Right to Buy, we have a further 35 days (49 days  for a flat) to send you details of the purchase price.
  • You may be able to buy with a member of your family who has lived with you for the past 12 months.
  • The maximum discount you will receive is £26,000 off the market value of the property.
  • If you sell your property within 5 years of buying it, you will have to pay back a proportion of the discount you received.
  • Right of First Refusal, if you purchase your home under the Right to Buy scheme on or after 18 January 2005, and you wish to resell or dispose of it within 10 years, you will be required to offer it to SARH at full market value. New Tenants
If you are a tenant who signed for your tenancy after 6 February 2006, you may have the "Right to Acquire" your home.  The conditions for this are similar to the Right to Buy, but the maximum discount you will recieve is £10,000 off the market value of the property.   The rules about repayment of the discount are similar to the Right to Buy Scheme.

Please note that if you apply to buy your home, we will only conduct business with the tenant(s) applying to purchase. We will not give any information to anyone else, including any companies arranging mortgages or claiming to be dealing with the purchase.

If you are thinking of buying another property on the open market, then perhaps the Governments Open Market Homebuy scheme is for you.  This scheme is open to tenants and applicants for housing registered on our Housing Register, but not available to tenants applying to buy their own homes under the Right to Buy.
